Remember the issue between Michael Lucas and Seth Treston? Last month, Jake Cruise removed the sex scene between Seth and Billy Santoro from his website because Seth was under exclusive contract with Lucas Entertainment.
These past few days, I posted behind the scenes photos of Seth on the set of Man Royale and Kink Men. I assumed that he was no longer Lucas’ exclusive model and now he changed his porn name from Seth Treston to Seth Santoro.
I was wrong, according to Michael Lucas, Seth still under that exclusive contract.
Seth Treston is a Lucas Entertainment model and yes he just violated his contract again. He is under the contract and he will remain so until the expiration of the agreement on June 17, 2016. In the meantime he has no right to work for any one else.
We are contacting all the studios letting them know that he is under an exclusive agreement.
Michael Lucas told me that the producer of Gay Room / Man Royale agreed with him and will not release the scene Seth shot for Man Royale.
Two gay companies, Jake Cruise and Gay Room have complied with Lucas Entertainment so far. Will Kink.com, the straight porn company comply? Today, Seth just participated in a big group sex scene for the website Bound In Public.
Last month, Jake Cruise released a sex scene between Seth Treston and Billy Santoro on COCKSUREMEN.COM. He removed the scene from his website after received an email from Lucas Entertainment.
Unfortunately I just discovered that Seth Treston was not truthful on his online application when he stated that he was not under contract with another studio. He is, in fact, under contract with Lucas Entertainment. When I shot the scene I trusted Seth was being honest with me.

According to Michael Lucas, Seth is under the contract with Lucas Entertainment until June 17. Lucas Ent. also contacted the producer of Gay Room / Man Royale website, the same way they contacted Jake Cruise AND the producer will not release the scene that features Seth.
Now, Seth is in San Francisco and working with KINK MEN, the gay division of Kink.com. I posted a picture and a video of Seth’s sex scene with Kip Johnson the other day.

That seems to be changing since Seth continues to get work outside of Lucas. Perhaps other studios see the budget cutbacks and personnel loss at Lucas as signs of a struggling studio that isn’t in the position to sue anyone over a breach of contract.

I’ve worked for several porn studios, gay and straight. Regardless the factual situation or contractual terms, I say let the actor perform wherever he wants, because so-called “exclusivity clauses” or “noncompete clauses” in adult contracts are usually illegal and unfair.
First, as far as exclusivity goes, the law is on the actors’ side. Under California law, noncompete clauses are void–meaning an actor can disregard them without placing himself in breach of contract. Meanwhile, Lucas Entertainment is headquartered in New York, where producing porn is technically illegal (although arrests or prosecutions are unheard of); only in the States of California and New Hampshire has adult film production been adjudicated as distinct from prostitution. Assuming that Lucas Ent.’s contract is written under New York law, the actor is free to ignore pretty much all of his contractual obligations as contrary to public policy until a New York court rules that producing pornography is lawful and distinct from illicit prostitution.
Furthermore, the expectation that an actor would obey all the terms of his contract would seem unfair and unreasonable to anyone who sat down to read these contracts. Gay porn studios are invariably unfair to their actors, paying them peanuts while claiming contractual rights worth a lot more than the actors’ pay. (And Lucas Ent. is known in the industry for paying on the low end.) These guys often come from shattered families or impoverished countries; they eagerly accept any work offered, sign contracts without reading them; the bargaining process is hopelessly one-sided. In “legitimate” film–indeed, in almost any business–an employee is paid not to work with an employer’s competitors; i.e., a noncompete provision would increase one’s pay vis-a-vis an employment contract without such a provision. But in porn, especially gay porn, where men are victimized more than their female counterparts in straight porn, these harsh terms are just thrown in because the studio drafts the contract.
The porn studios often attempt to scare actors into compliance, insinuating that violating the terms of their contract is a crime punishable by jail time. In reality, if an actor violates his noncompete or exclusivity provision of his contract, nothing happens. At worst, the offended studio might not work with that actor again. In an industry where nothing changes but the faces, studios want to own an actor’s image without paying him. Trust me, these actors are not paid much, maybe $50K per year if they work very often, which is why they seek as much work as possible. Sure, if Lucas Ent. or any other studio (Sean Cody and Corbin Fisher are even more guilty of harsh contractual terms) offered steady work year-round, an actor would probably remain with a single studio. But the fact is, no single studio will hire any particular actor enough to pay the bills of the typical young American male living in the big cities where porn is filmed. The actors are often uneducated and desperate, so they sign whatever is put in front of them. Often not even a studio advises the actor as to its expectations of him.
In sum, unless an actor is paid a guaranteed salary that would keep him comfortable year-round (as Corbin Fisher is rumored to do, although I would be curious to know the actual terms of that studio’s contracts) then expecting an actor not to accept as much work as possible is unreasonable and unfair.
